Are Defendants holding back documents in discovery? Have you modified your discovery requests many times and still not received the documents that you requested?
You can get the documents!

Our client was having difficulty obtaining seat drawing documents from a major automotive manufacturer. Discovery requests were submitted specifically requesting design drawings of the seat and seat recliner. The defendant insisted that they were "searching" and would produce the requested drawing(s) as soon as these drawings could be located.

LSSLC, LLC was asked to assist in locating seat  documents outside of the discovery process. Linda Sherman went to work and did some research at NHTSA. There she found that the subject seat had been part of a NHTSA P.E. (Preliminary Investigation) which grew into a full investigation. As part of this full investigation, the auto manufacturer was asked to submit drawings of the seat and seat recliner. This was specifically what we were looking for. We got the drawings from NHTSA, had them copied and certified.

Now we have drawings that we can produce to our client attorney's case experts that will help strengthen their opinions about this defective seat. These certified drawings can also be used at trial as exhibits.

Moral:  Be creative and tenacious in the discovery phase. There are many resources for valuable documents outside of the traditional discovery process. Keep digging.
