Other similar incidents or OSIs can be invaluable,
paying off several times more than the investment cost for securing them. LSSLC, LLC has developed a process for finding hard to get OSIs in automotive and other product liability cases. We currently have developed databases for rollover, roof crush, seat belts, air bags defects and other defective products.

Use at settlement and mediation

Many of our attorney clients are using the OSI material that we obtain as part of their settlement and mediation negotiations. Visual depictions such as photographs of the product from other filed lawsuits or charts and spreadsheets showing a substantial number of OSIs can be powerful tools of persuasion.

Here is an example of similar vehicles showing very similar roof deformation. The design of this roof makes it inherently vulnerable and weak in a rollover accident.
A visual representation duplicated multiple times through the gathering of OSIs can show that this product has a design defect in the roof. It tends to deform in the same way regardless of the number of rolls or on what terrain it rolled.

Use at trial

Some of our clients want to save their OSI presentations for trial exhibits. Often we provide them with authentication documentation such as the police report and Complaint. We have collected pertinent depositions and some attorneys will depose a witness or party in their own to show that a similar incident was experienced by other people and not just their client.
