New Jersey Tax Ruling Could Cause Big Liabilities

New Jersey court recently ruled that the throwout rule, for sales factor purposes, does not violate the Due Process, Commerce, and Supremacy Clauses of the United States Constitution.  We're not a New Jersey company you say?  Well, a corporation could now be deemed to have nexus in New Jersey even with zero New Jersey property, payroll, and minimal New Jersey receipts.  This could result in a large New Jersey apportionment factor.
